Healthcare Professionals: Is Your PI Cover Keeping Up with Your Practice?

Healthcare Professionals: Is Your PI Cover Keeping Up with Your Practice?

Whether you work independently, run a clinic or provide services across several healthcare settings, it’s important to understand what your Professional Indemnity (PI) arrangements cover.

A claim may arise from alleged errors in diagnosis, treatment or professional advice. Responding to that claim can involve legal and expert costs, even where liability is disputed.

For registered healthcare practitioners, appropriate PI arrangements are also a professional registration requirement.

Does your cover match your scope of practice?

Ahpra requires registered practitioners to have PI arrangements appropriate to all aspects of their practice, in accordance with their National Board’s registration standard.

That means your cover should reflect the services you actually provide, not simply your professional title.

Consider whether you’ve introduced new treatments, changed your clinical activities, taken on supervisory duties or started working in another setting.

If your work changes, your insurance arrangements may need reviewing too.

What does healthcare PI cover?

PI insurance can respond to certain claims alleging that an error, omission or breach of professional duty caused a patient harm.

Depending on the policy, it may cover legal defence costs and compensation or damages for which the insured becomes legally liable.

Some policies also offer additional benefits for professional disciplinary proceedings, regulatory investigations or coronial inquiries.

These benefits vary, so check whether they’re included and whether separate limits or conditions apply.

Who is actually insured?

This is particularly important for practice owners.

If your clinic employs practitioners, engages contractors or uses locums, check who is covered under the policy and for which activities.

You should also check whether the practice entity itself is insured if a claim is made against both the business and an individual practitioner.

If you work across multiple clinics, don’t assume one employer’s PI arrangements automatically cover your work elsewhere.

What happens when you stop practising?

PI is commonly written on a claims-made basis, so a claim arising from earlier treatment may be made after you retire, leave a practice or change insurers.

Run-off arrangements and continuity of cover should be considered before an existing policy is cancelled. Some practitioners may have access to profession-specific arrangements.

It’s worth reviewing your PI cover whenever your scope of practice, staffing or business structure changes.

Speak with your Insurance Advisernet adviser about your clinical activities, who needs to be insured and whether your current cover reflects the way your practice operates.
